VA Fights Off Retired Worker’s Race, Age Discrimination Claims

The Department of Veterans Affairs defeated a suit alleging it discriminated and retaliated against a Black retiree, following a ruling that he lacks evidence for some claims and failed to follow procedural rules for others.

The former VA worker challenged years of reprimands and promotion denials, but he waited too long to pursue some allegations, failed to exhaust his administrative remedies for others, and didn’t provide enough evidence to support going to trial on the rest, the US District Court for the Northern District of Illinois said Wednesday, granting summary judgment to the agency.
