Utz Delivery Workers Are Misclassified, Owed Overtime, Suit Says

Utz Quality Foods LLC and a related company misclassified delivery workers as exempt from minimum wage and overtime pay requirements, a new wage-and-hour suit alleges in federal court in New York.

The snack food company employs Felix Diaz as a delivery worker in Brooklyn, but hasn’t paid him overtime even though he typically works 72 hours per week, according to a complaint filed Monday in the US District Court for the Southern District of New York.
