Specialty worker visa seekers whose applications were resubmitted for the 2021 fiscal year and rejected or closed because they didn’t start their jobs by Oct. 1, 2020, can submit their applications again, U.S. Citizenship and Immigration Services said Wednesday.
The announcement follows a March lawsuit in which employers said the agency arbitrarily rejected their H-1B visa workers’ applications filed after Oct. 1 because of their staggered job start dates, and that no law requires them to start by the first day of the fiscal year.
