US Foods Employees’ $3.5 Million Overtime Deal Gets Early Nod

A $3.5 million settlement between US Foods Inc. and nearly 460 employees, who worked as corporate buyers in Illinois and were allegedly misclassified as exempt from overtime pay, won preliminary approval from a federal judge in Chicago.

The deal will resolve claims brought by Ann Ford in 2019 under the Fair Labor Standards Act and Illinois wage law. The members of the Illinois class and FLSA collective are expected to split about $2.2 million of the total amount.

Class counsel plans to seek $1.2 million in attorneys’ fees and litigation expenses. The deal also provides $60,000 worth of service awards ...
