An International Brotherhood of Teamsters’ lawsuit against United Parcel Service over the company’s voluntary resignation program should be resolved in arbitration and not federal district court.
Chief Judge Denise J. Casper of the US District Court for the District of Massachusetts denied the union’s request for a preliminary injunction, finding that the Teamsters didn’t meet the high legal threshold to circumvent arbitration.
“Here, the Union has failed to demonstrate that this is one of the rare cases warranting issuance of a labor injunction,” Casper said in the Feb. 20 opinion.
