UPS Gets Another Shot to Defend Information Refusal at NLRB

The National Labor Relations Board must reconsider certain arguments presented in an unfair labor practice case against United Parcel Service Inc. after a federal appeals court ruled it failed to properly analyze them.

The board didn’t analyze whether UPS’s duty to hand over records about seasonal workers was precluded by the parties’ collective bargaining agreement in its 2023 ruling against the shipping firm, the US Court of Appeals for the Eleventh Circuit held Friday. It upheld the remaining portions of the board’s ruling.
