UPS Fights Off Deaf Worker’s Disability Discrimination Claims

United Parcel Service Inc. defeated the bulk of a deaf worker’s disability bias lawsuit with prejudice, but a federal judge gave the employee permission to amend his failure-to-accommodate claim.

The worker wasn’t qualified for a driver position under the Americans with Disabilities Act when UPS moved him to a different role, the US District Court for the District of Utah said. The court also threw out the worker’s Rehabilitation Act, language-based bias, First Amendment, and emotional distress claims, but gave him 14 days to fix up the accommodations portion of the complaint.
