UPS Fights Off California Worker’s Unpaid Wage, Break Claims

United Parcel Service Inc. is free for now of a proposed class action alleging it stiffed some California workers on pay and failed to provide proper breaks.

The worker who filed the lawsuit didn’t sufficiently allege UPS owes him unpaid minimum or overtime wages or violated state law on meal and rest breaks, the US District Court for the Central District of California said. Some of the statutory provisions he invoked don’t provide a private right of action or allow workers to seek penalties in his situation, the Monday order said.
