The University of Pennsylvania told a federal judge the EEOC’s attempt to compel the school to supply a list of employees that revealed Jewish faith or association with Jewish studies and programs is unconstitutional.
UPenn asked the US District Court of the Eastern District of Pennsylvania in a filing Tuesday to deny the Equal Employment Opportunity Commission’s subpoena enforcement action.
UPenn’s trustees sued by the agency said the request is “not only disconcerting but also entirely unnecessary” as the Philadelphia school has sought to comply with the investigation short of supplying such a list identifying certain faculty members.
