Unum Ex-Workers Proceed With Lawsuit Seeking Overtime Wages

Unum Group Corp. failed to persuade a federal judge that former employees seeking allegedly unpaid wages were exempt from overtime protections.

The four lead plaintiffs in a proposed class action against the company argued they were misclassified as exempt from the Fair Labor Standards Act and Maine wage regulations.

Judge Curtis L. Collier, of the US District Court for the Eastern District of Tennessee, on Wednesday partly denied Unum’s motion for summary judgment, finding there are still questions as to whether the employees were owed overtime. Collier also denied the ex-workers’ summary judgment.
