John Ellis’ claim that the airline discriminated against him in violation of the Americans With Disabilities Act fails because he didn’t establish that he is disabled, Judge Matthew F. Kennelly of the US District Court for the Northern District of Illinois said.
“The fact that United perceived Ellis as having a higher risk of contracting Covid-19 in the future due to his unvaccinated status does not allege a disability under the ADA,” Kennelly said Tuesday.
