A union asked the US Supreme Court for permission to challenge an appeals court decision that makes it easier for employers to get a judge to block National Labor Relations Board cases accusing them of violating workers’ rights.

The Office and Professional Employees International Union is seeking high court review of the US Court of Appeals for the Fifth Circuit’s decision that froze NLRB cases involving SpaceX and two other companies because the agency chose not to fight it, the AFL-CIO, which counts the OPEIU as a member, announced Wednesday.
