Union Pacific Worker Benched Over Bad Hip to Get Job Bias Trial

A jury must decide if Union Pacific Railroad Co. violated disability discrimination law by imposing restrictions on a track worker because of his bad hip, disqualifying him from his position, an Omaha federal judge ruled.

The issues for trial include whether Phil Silos was a “qualified individual with a disability” under the Americans with Disabilities Act at the time of the company’s actions, the US District Court for the District of Nebraska said.
