Union Dissident Loses Court Challenge to Labor Board Ruling (1)

The National Labor Relations Board had sufficient cause to reject a transit worker’s allegation that his union illegally tried to get him fired for being a thorn in its side, a divided federal appeals court ruled.

The NLRB had substantial evidence to conclude that a shop steward didn’t attempt to convince Transdev Services Inc. to terminate Thomas McLamb for his role in a workplace confrontation with another union officer, the US Court of Appeals for the District of Columbia Circuit held in its 2-1 decision Tuesday.
