Although Uber has an interest in limiting who speaks for the company about a lawsuit, its directive went too far by covering employees’ personal speech, NLRB Associate General Counsel Jayme Sophir said in a memorandum made public Dec. 17. Uber could protect its business interests “with a much more narrowly drawn proscription that would not silence employees altogether,” Sophir wrote.
