Uber Asks SCOTUS to Undo Ruling Allowing UberBLACK Drivers’ Suit

Uber Technologies Inc. asked the U.S. Supreme Court to reverse a Third Circuit decision that revived a Fair Labor Standards Act lawsuit alleging it misclassified UberBLACK drivers in Pennsylvania as independent contractors, instead of employees entitled to minimum wages and overtime.

UberBLACK drivers saw their suit reinstated in March 2020, when the U.S. Court of Appeals for the Third Circuit found genuine factual disputes concerning Uber’s level of control over the drivers’ work and profit opportunities. The opinion was the first federal appeals court decision to address UberBLACK drivers’ classification under the FLSA standard.
