Trump Order ‘Disfavors’ Criminal Enforcement of Agency Rules

Federal agencies should consider civil rather than criminal enforcement of their regulations, according to an executive order President Donald Trump signed May 9.

Agencies should also avoid imposing a “strict liability” standard to their rules, the order said, noting that the massive Code of Federal Regulations “is far more than any citizen can possibly read, let alone fully understand.” Strict liability means a person or entity is in violation regardless of their intention.
