Trump Joint Employer Rule Is Moot, Biden DOJ Tells 2nd Circuit

The Biden administration asked a federal appellate panel to dismiss a lawsuit that seeks to revive a Trump-era regulation that shielded companies from joint liability over the payroll practices of their affiliated businesses, such as franchisees.

U.S. Justice Department attorneys filed a motion late Wednesday requesting the U.S. Court of Appeals for the Second Circuit to declare an appeal in the case moot; it cited the U.S. Department of Labor’s action under President Joe Biden to rescind the Trump administration’s business-friendly “joint employer” measure.
