Biden administration lawyers are fighting to protect a contentious Trump-era regulation—shifting the H-1B specialty occupation visa selection process from a random lottery to one based on wages—from corporate heavyweights’ efforts to undo it.

The planned change was made during a time when Department of Homeland Security leadership had passed from the Senate-confirmed Kirstjen Nielsen, to acting secretary Kevin McAleenan and then to acting secretary Chad Wolf—a line of succession multiple federal judges had said was likely unlawful, including Oakland, Calif., U.S. District Judge Jeffrey White, a potentially fatal blow to actions taken by the DHS during that time.
