An Oklahoma trucking company asked a federal judge to halt an upcoming whistleblower hearing at the Department of Labor, alleging the proceeding violates their constitutional rights.
Western Flyer Express claimed that the DOL is infringing upon its Seventh Amendment right to a jury trial and that the department’s administrative law judges are unconstitutionally shielded from removal in its lawsuit filed with the US District Court for the Western District of Texas Thursday.
