Trucking, Building, Retail Groups Fighting Shot-or-Test Rule (1)

Major industry groups representing construction, retailers, trucking, and small businesses challenged the legality of the federal Covid-19 vaccine-or-testing mandate on large employers—joining the wave of lawsuits filed in at least eight U.S. federal appellate courts.

The National Federation of Independent Business filed a lawsuit Tuesday in the U.S. Court of Appeals for the Fifth Circuit in New Orleans, joined by industry groups including the American Trucking Association and the National Retail Federation. They argued the Occupational Safety and Health Administration overstepped its authority in issuing an emergency temporary standard for Covid-19 workplace safety.
