An Illinois truck driver who says Select One Inc. misclassified workers as independent contractors when they’re really employees fought off the company’s attempt to get the case thrown out of federal court Friday.
The driver sufficiently pleaded that he was an employee under the Fair Labor Standards Act and that his work in Illinois brought him under the protection of the state’s wage laws even though he lived elsewhere, the US District Court for the Northern District of Illinois said. The court also conditionally certified an FLSA collective.
