Cornell University defeated a transgender doctor’s bid to be immediately restored as an active employee while their sex discrimination lawsuit proceeds against the school, NewYork-Presbyterian Queens, and their former supervisor.
Mackenzie Lerario failed to carry the heavy burden needed for a preliminary injunction, which is among “the most drastic tools” a judge can use, the US District Court for the Southern District of New York said. And that burden was a heavier one than usually applies when such preliminary relief is sought, because the injunction requested by Lerario would have been “mandatory” rather than “prohibitory,” the court said.
