Nearly 500 current and former foundry workers in Wisconsin, Indiana and Tennessee can proceed as three separate sub-classes in a long-running Fair Labor Standards Act donning and doffing action, a federal judge in Wisconsin ruled (DeKeyser v. Thyssenkrupp Waupaca, Inc., 2016 BL 102606, E.D. Wis., 08-00488, 3/31/16).
Partially decertifying the workers’ FLSA collective action, Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin found that federal district courts in those states would be more convenient forums.
