The National Labor Relations Board was wrong to find that a New Jersey nonprofit company violated federal labor law related to its involvement in an employee effort to eject their union, a federal appeals court ruled.
The NLRB lacked sufficient evidence to support its determinations that New Concepts for Living Inc. illegally solicited employees to resign from a Communications Workers of America affiliate, bargained in bad faith, polled its workforce on union support, and withdrew its recognition of the union, the US Court of Appeals for the Third Circuit ruled Monday.
