Texas Staffing Agency Settles EEOC Mental Health Disability Case

Peak Performers, an Austin, Texas-based staffing agency, agreed to pay $160,000 to a disabled former employee to end a discrimination lawsuit filed by the EEOC.

The Equal Employment Opportunity Commission alleged that Peak Performers denied a brief unpaid leave request to an executive assistant with mental health-related disabilities who needed time off to receive outpatient medical treatment following a suicide attempt. The company fired her in April 2024, even though she would have been able to return to work within three weeks after completing her treatment, the EEOC said.
