Two Texas staffing agencies failed to prove that they weren’t negligent for the injuries of an employee who allegedly wasn’t qualified to work at the company he was placed at, a Texas court of appeals ruled.
NCH Corp. and its subsidiary Retail Products Group, which used staffing agencies ESI/Employee Solutions and Employee Solutions Arlington to hire workers for its distribution center, won’t have to pay ESI and ES for attorney’s fees, expenses, and other costs in a suit arising from forklift driver Timothy Price’s injury, the Texas Court of Appeals, Fifth District, said.
