Texas Radiographer’s Appeal Fails in Flu Shot Accommodation Suit

A Texas Children’s Hospital radiographer can’t revive her failure-to-accommodate case after the hospital ultimately accommodated her request for a religious exemption from receiving a flu shot, the Fifth Circuit ruled.

The Christian worker argued that the lower court wrongly granted her employer summary judgment after ruling that it’s undisputed that TCH accommodated her beliefs. But she didn’t provide a good reason for the US Court of Appeals for the Fifth Circuit to overturn that decision, the panel majority said in a brief Monday opinion, which included a dissent more than three times as long.
