Texas Produce Companies Challenge Work Safety Agency’s Oversight

Congress unconstitutionally delegated its duty to set workplace safety standards to the Labor Department, a trade association that represents produce companies said in a lawsuit seeking to dissolve those standards.

Congress violated the nondelegation doctrine by broadly giving away its power to define workplace safety standards to the US Occupational Safety and Health Administration, according to the complaint filed by the Texas International Produce Association in the US District Court for the Northern District of Texas.

TIPA asked the district court to block the agency from enforcing and promulgating any of its safety standards.
