Texas Hispanic Faculty Advance Some Individual Pay Bias Claims

Two Hispanic professors at the flagship University of Texas campus can pursue some individual claims that the school engaged in national origin-based pay discrimination, but their allegations on behalf of a would-be class fell short.

The professors say the University of Texas at Austin paid them less than non-Hispanic faculty and promoted them at a lower rate. The duo sufficiently alleged their disparate impact and disparate treatment claims, but they can’t pursue retaliation claims or any claims on behalf of a proposed class, the US District Court for the Western District of Texas said Monday.
