Texas Beats Bias Suit Over Allegedly Wrong Drug Test, For Now

The Texas Department of Criminal Justice defeated part of a former officer’s lawsuit claiming he was discriminated against based on his military service when the department fired him for a positive drug test allegedly caused by his PTSD medication.

The US District Court for the Northern District of Texas dismissed military veteran Robert Fuentes’ Uniformed Services Employment and Reemployment Rights Act claims on Aug. 4 because the state is entitled to sovereign immunity for such claims brought in federal court.
