The United States and Cumberland County, Tenn., have settled a disability discrimination suit stemming from the constructive discharge of a corrections officer who failed a drug test due to medication he was prescribed to treat his opioid use disorder.
The parties asked the US District Court for the Middle District of Tennessee to approve a consent decree on Wednesday that would require Cumberland to pay the unnamed officer $160,000, revise its drug prohibition policy, and provide written reports about its compliance to the Department of Justice over an 18-month period.
