Tenneco Asks Supreme Court to Weigh ERISA Arbitration Doctrine

Auto part maker Tenneco Inc. asked the US Supreme Court to send a challenge to its retirement plan fees into arbitration, saying the justices should reject a judge-made doctrine that’s wrongly allowed several ERISA disputes to remain in court.

Tenneco wants the justices to review an August decision refusing to enforce an arbitration clause in its retirement plan based on the clause’s requirement that claims be brought in an individual capacity and that any relief awarded be individual in nature.
