Tech Company Fails in Lawsuit Over Guestworker Visa Denials

An information technology services company lost its bid to overturn denials of skilled guestworker visas for two of its employees.

The Dec. 17 decision from a federal judge in Michigan could be a setback for other businesses, which currently are considering litigation over the increased scrutiny they’re facing when seeking H-1B visas. U.S. Citizenship and Immigration Services increasingly has been denying employers’ H-1B petitions on the grounds that the jobs aren’t “specialty occupations” as required under the law.
