Target Facing Trial on Employee’s OT Exempt Status in FLSA Suit

Target Corp. must continue litigating a proposed collective action alleging it misclassified certain employees as exempt from the Fair Labor Standards Act’s overtime rules, after a federal judge in Minnesota denied summary judgment as to a named plaintiff.

There exists a genuine factual dispute over whether management is Tammy Babbitt’s primary duty as an “Executive Team Lead,” Judge Donovan W. Frank said Wednesday in denying Target’s motion.
