The US Supreme Court is set to consider whether federal judges must dismiss employment cases subject to mandatory arbitration or whether they should instead pause them pending the outcome of private dispute resolution proceedings.
The issue, scheduled for oral argument Monday, is at the center of a lawsuit from a group of drivers accusing delivery service company IntelliQuick Delivery Inc. and some related entities of misclassifying them as independent contractors when they were really employees.
The alleged misclassification wrongly denied them minimum wage, overtime, and paid sick leave protections under federal and Arizona state law, the drivers said.
