Supreme Court Review Sought for H-1B Spouses’ Work Permit Rule

A group representing American-born tech workers is asking the US Supreme Court to hear a challenge to employment authorization for spouses of H-1B visa holders.

Save Jobs USA has argued that the Department of Homeland Security exceeded its authority in work authorization rule for dependent H-4 visa holders. It argued in a cert petition Thursday that high court review was necessary because of a circuit split created by separate litigation over the Deferred Action for Childhood Arrivals program.
