Supreme Court Rebuffs Surgeon’s Challenge to Reporting Scheme

The US Supreme Court rejected a surgeon’s constitutional challenge to a federal system for alerting hospitals of “adverse action reports” on candidates for physician jobs.

The justices announced Monday that they’ll let stand the US Court of Appeals for the District of Columbia Circuit’s February ruling that threw out the lawsuit. The surgeon, identified in case papers as John Doe, alleged that the Health Care Quality Improvement Act of 1986 and the implementing regulations—which require hospital notice of the reports—violated his due process rights.
