Supreme Court Invites Briefs on Oklahoma Drug Pricing Case (1)

The US Supreme Court asked the US Solicitor General to file briefs over a challenge to an appeals court decision that held major portions of an Oklahoma statute imposing restrictions on pharmacy benefit managers violate federal law.

The high court’s request on Monday indicates it is interested in the case, which will test the boundaries of states’ legal ability to regulate PBMs—entities that manage prescription drug benefits for health insurance plans but have been criticized for some of their business practices.
