A wholesale grocery warehouse worker must arbitrate his individual allegations under a unique California law allowing employees to step into the state’s enforcement shoes.
Plaintiff Travis Shanley signed agreements to arbitrate any wage-and-hour claims against C&S Wholesale Grocers LLC and subsidiary Tracy Logistics LLC, the US District Court for the Eastern District of California said in an order filed Thursday. Athough he qualifies for a federal arbitration exemption for transportation workers, state law still requires him to arbitrate his individual Private Attorneys General Act allegations, the court said.
