Subcontractor Gets $78,000 Worker Safety Penalty Thrown Out

A construction company won its bid to vacate four workplace safety citations, carrying a more than $78,000 penalty, after an administrative law judge found that it didn’t have control over the workers as a subcontractor.

OSHA didn’t provide sufficient evidence that Pettengill Family Restoration controlled the manner or means by which work was performed, ruled Brian A. Duncan, an administrative law judge for the US Occupational Safety and Health Review Commission.
