Student Athletes’ Wage Claims Against NCAA Get Green Light

The NCAA failed to shake off claims by college student athletes who say they should be paid for their participation in Division I interscholastic athletic activity.

The students may pursue their Fair Labor Standards Act claims against the NCAA because they plausibly allege it is a joint employer along with their schools, the U.S. District Court for the Eastern District of Pennsylvania said Wednesday.

Two different entities can be joint employers of the same person if they both have “significant control” over the employee, the court said.
