An Atlanta strip club violated the Fair Labor Standards Act by failing to pay a dancer hourly wages, the Northern District of Georgia ruled Jan. 28.
The club misclassified Brezzy Hurst as an independent contractor, rather than an employee, and required her to pay out-of-pocket for the privilege of working, the court said.
The club’s exercise of control over Hurst’s work shows that she was an employee, the court said.
