A Virginia federal court declined to toss or put on hold a Selective Insurance Group Inc. unit’s suit against a countertop company over coverage for underlying stoneworker injury claims in favor of a parallel California state court case.

“Given the lack of progress in the state case and the appearance of forum shopping by both parties, the state action’s one month seniority over the federal action does not tilt the scales in favor of abstention,” US District Court for the Eastern District of Virginia Judge Jamar K.
