The union representing Starbucks workers is asking a federal appeals court to overturn a judge’s order requiring it to turn over internal communications it says will “irrevocably damage” organizing efforts by revealing confidential strategies.
The district judge’s order enforcing Starbucks’ subpoenas is an abuse of discretion and raises important legal issues that the US Court of Appeals for the Second Circuit hasn’t yet ruled on, Starbucks Workers United argued in a petition filed Wednesday. Those factors warrant special appellate court intervention, the union said.
Normally litigants can’t challenge such orders until there’s a final judgment in their case.
