Starbucks Wins Fifth Circuit Challenge to NLRB Firing Ruling (2)

Starbucks Corp. prevailed in its appeals court challenge to a National Labor Relations Board decision that the company illegally fired a worker for his union activities.

The US Court of Appeals for the Fifth Circuit on Thursday vacated the NLRB’s ruling that Starbucks violated federal labor law when it fired a shift supervisor who helped organize a store near Albany, N.Y. The court sent the case back to the board for additional scrutiny of the record.

“We are not convinced the Board adequately considered contradictory evidence,” Judge James Graves, an Obama appointee, wrote for the court.
