Starbucks COBRA Notice Suit Will Stay in Court, Not Arbitration

A proposed class action challenging the notices Starbucks Corp. sends former employees informing them of their health coverage rights can stay in court, after a Florida federal judge determined that one of the named plaintiffs wasn’t bound by the arbitration agreement covering his wife.

Raphyr Lubin, who was covered by the Starbucks health plan until his wife was terminated by the coffee chain in 2019, can maintain a federal lawsuit against the company despite an arbitration clause in his wife’s employment agreement, Judge Charlene Edwards Honeywell of the U.S. District Court for the Middle District of Florida ruled Monday.
