A staffing agency that’s barred from making some travel nurses arbitrate wage-and-hour allegations can’t enforce similar restrictions against others who join the lawsuit, a federal judge said.
Aya Healthcare Inc. essentially wants an indefinite delay to the suit while more than 200 additional workers individually arbitrate whether their agreements with the staffing firm are enforceable, the US District Court for the Southern District of California said. The district court confirmed most of the other nurses’ earlier victories last year, and on Tuesday said that outcome precludes revisiting the other pacts’ enforceability.
