St. Edward’s White Baseball Coach’s Retaliation Claim Advances

A White baseball coach at St. Edward’s University in Texas, who was fired after two investigations concluded he didn’t discriminate against two Black players, can proceed with his retaliation claim against the university, but his discrimination claim was axed.

A reasonable jury could conclude that SEU terminated Rob Penders immediately—instead of waiting for the end of the baseball season—because he complained that the school was discriminating against him, Judge David A. Ezra of the US District Court for the Western District of Texas said Monday.
