Speedway LLC convinced a federal judge to decertify a Fair Labor Standards Act collective of more than 1,260 convenience store managers who claim they’re misclassified as exempt from overtime pay.
The employees’ work environments varied significantly depending on the Speedway locations they worked at, making it impossible to determine if they were misclassified without delving into their individual circumstances, Judge Richard G. Stearns said Monday.
